Instinct Gym & Wellbeing – Terms & Conditions (Effective 1 January 2026)

These Terms & Conditions apply to all memberships at Instinct Gym & Wellbeing (“Instinct”). By joining or continuing your membership, you agree to be bound by the terms set out below. These Terms & Conditions supersede all previous versions.

 Our policies are designed to provide clarity, fairness, and flexibility for members, while allowing our coaching team to deliver the high standard of service Instinct is known for.

 

Principle Terms

Introduction & Definitions

      In this document, “the Company” means Instinct Gym & Wellbeing (also referenced as Instinct), which is the trading name for Instinct Wellness Limited, with company number 09067410 and registered office Enigma House, 76 High Street, Tarporley, CW6 0AT.

      “We” means Instinct Gym & Wellbeing, “Member” means an Instinct Gym & Wellbeing Member.

      It is a condition of membership that Members agree to pay the fees referred to in section 2 and agree to be bound by these terms. These terms may be revoked, altered or added to from time to time by the Company, without prior notification to Members. Any amendments will be updated on our website.

      The Company has created these Terms and Conditions for the mutual benefit and enjoyment of our Staff, Members, and guests.

      The enforcement of this document is for the good of all Members. Instinct Gym & Wellbeing strongly believes in inclusivity, No Member or guest will be judged on the basis of their race, gender, marital/civil partnership status, age, disability, religion or belief, colour, national origin or sexual orientation.

 

Health & Safety & Member Responsibility

By participating in training at Instinct, members confirm that:

      They are medically fit to engage in physical exercise

      Any injuries, medical conditions, or changes in health are disclosed to the coaching team

      Training is undertaken within personal limits

While coaches provide instruction and supervision, all training is undertaken at the member’s own risk. Instinct is not liable for injury resulting from failure to follow coaching guidance, misuse of equipment, or undisclosed medical conditions.

Members must follow all gym rules, safety procedures, and reasonable instructions from staff at all times.

 

Memberships Overview

      Members must be at least 14 years of age. Proof of age may be required and a PARQ for under 18 must be signed by a parent or guardian.

      Membership payments are payable monthly in advance.

      Monthly subscription runs from the 1st or the 15th of each month. Payment of monthly membership can only be made by Card via Mindbody.

      Members must keep the Club informed of their up-to-date contact detail

      The Company reserves the right to refer any missed payments to a debt collection agency and will charge you a fee, in respect of failed subscription payments and/or collection letters sent to you in respect of unpaid amounts.

      Upon termination of membership, no refund of monthly fees or other fees shall be issued.

      To re-join Instinct Gym & Wellbeing following a termination of membership, any unpaid subscriptions must be cleared; a new membership agreement completed (including any increase in price)  and the prevailing admin fee may be charged.

 

Lockers

      Lockers may be available for use by Members and their guests while they are on Instinct premises, subject to availability.

      Members must ensure that the contents of the daily lockers are removed at the end of their visit.

      The Company reserves the right to open lockers without the Member’s permission or the Member being present.

      The Company reserves the right to remove the contents from any locker, which has not been emptied after the visit. Property cleared from lockers, or left on the premises, shall be held for between 10 – 31 days, depending on storage available onsite. Unclaimed items are donated to charity.

 

Membership Structure & Session Validity

Instinct memberships may include allocated training sessions (classes, semi-private training, or one-to-one personal training).

      Sessions are allocated monthly as part of your membership

      All sessions remain valid for up to two months from the date of allocation

      Sessions are automatically carried over into the following month if unused

      Sessions will expire at the end of the second month

      Sessions cannot be extended beyond this two-month window

While members are encouraged to use sessions within the month they are allocated, the extended validity period is designed to provide flexibility around work, holidays, and family commitments, while allowing coaching availability to be managed fairly.

 

Booking Access & Availability

Because sessions now remain valid for a longer period, booking access is no longer limited to the month of purchase.

Members are able to:

      Book sessions up to 30 days in advance

      Access availability beyond the 1st and 15th of each month

This system is designed to reduce booking congestion and spread availability more evenly across the calendar.

 

Credits & Session Use

Training credits:

      Are non-transferable and may only be used by the named member

      Cannot be exchanged for cash or refunded

      Must be used within the validity window

      Will expire if unused after this period

Expired credits cannot be reinstated under any circumstances.

 

Session Conversions

Where sessions begin to accumulate and it is unlikely they can be used within the validity window, Instinct may offer session conversion options to help protect member value.

Available conversion options:

      4 Classes → 1 Semi-Private Personal Training session

      8 Classes → 1 One-to-One Personal Training session

      2 Semi-Private sessions → 1 One-to-One Personal Training session

All conversions:

      Are subject to availability

      Must be agreed in advance with the coaching team

      Must be used within the same timeframe as the original expiring sessions

 

Membership Pausing & Suspensions

Instinct supports membership pauses for longer holidays, injury, or illness, with the following structure in place:

      All pauses require an agreed return date

      Open-ended suspensions are not offered

      Pause requests cannot be applied retrospectively

For short holidays or brief periods away, there is no requirement to suspend your membership. The two-month session validity period is designed to cover these situations, allowing sessions to be used before or after time away without loss of value.

For injury or short-term illness, memberships may be paused for up to 30 days, with extensions reviewed where appropriate. Long-term illness will always be handled on a case-by-case basis.

Members are encouraged to speak with a coach if injured. A 30-minute rehabilitation consultation is available and may be purchased or exchanged for unused sessions where appropriate.

 

Student Memberships

Student memberships are available to eligible members with valid student identification.

      Proof of student status may be requested at sign-up and during the membership term

      Student memberships are subject to the same session validity, booking, pause, and cancellation policies unless otherwise stated

If student status changes, Instinct reserves the right to move the membership to an appropriate alternative option

 

Fees & Annual Review

Membership fees are reviewed annually to ensure service quality, staffing levels, and facility standards are maintained.

      Any changes to pricing will be communicated with reasonable notice

      Fee changes will typically take effect from 1 January each year, unless stated otherwise

Fee reviews do not alter existing cancellation notice requirements

 

Membership Cancellations

To maintain consistency across all memberships:

      A minimum of one full calendar month’s notice is required for cancellations

      Cancellation requests must be submitted in writing or via email

      Memberships remain active and chargeable during the notice period

 

Complaints Procedure

Instinct is committed to providing a high standard of service. If a member is unhappy with any aspect of their experience:

      Concerns should be raised with a member of the coaching or management team as soon as reasonably possible

      Complaints may be submitted in writing via email to allow full investigation

      All complaints will be acknowledged within 5 working days where possible and handled fairly and professionally

Raising a complaint does not affect membership rights, and all feedback is welcomed as part of our commitment to continuous improvement.
